Lagal issue for TG?

I have an idea for a novely track that I dont want to give away just yet. However, it involves combining alchohol with gameplay. Now surely TG doesnt want to in anyway be responsible for people harming themselvse, so i'd include a rule like only one beer, if you get two drunk that would be a disqualfication. As long as rules are put in place to ensure only responsible drinking is encouraged would such a track be fine or would I have to admin removing the track?

@admin staff I believe i can do this in a very fun way, and due the particular game I"m thinking of I suspect alot of peole would like it. I dont wanna throw away my submission points thouhg if the track is just going to be admin deleted

any guidance is appreciated

    I like the idea, but if there is gonna be a one-beer-only rule, you might as well elimnate the alcohol entirely. I don't think one beer would make any difference at all.

    i agree, i often drink while i play and I find the one-two beer range actually improves my gaming on some titles where I might be trying to force the gameplay...it allows me to relax a bit which outweighs the limited impairment that might be occuring

    thx guys, that just an example and the exact sort of thing thats open to debate before i make the track. my only point is there may need to be some sort of limit for liabilty. i'm not a lawyer, but i do know how sue happy people get.

    I once PM'd Dave about making a track for Untappd, the beer app. Most badges on a single check in. I had similar concerns. His response was pretty much "discuss with the community"

    ok so what concerns do you guys think should make its way into the track? the only thing i'm thinking is some sort of max. heck, we could even include a field sobriety test at the end. that'd be fun, as well as a way to make sure not too much alchohol. and unlike real sobriety tests, we'd of course have to allow some alchohol, thats the entire point, maybe just DQ you if your to the point its dangerous and not something we want to encourage?

    I'm honestly OK with a track like this. (Seeing as the Contra Chicken wing challenge exist - LOL) As long as it's placed in the proper location platform wise and the rules are written VERY CLEARLY in a way that any (and all) player(s) will remain safe.

    I feel like these silly tracks need a home and right now I don't think "Novelty" is the place for it. Seeing as the novelty platform contain actually competition for electronic gaming. (but not quite video games)

    Off the top of my head, the current place seems like it would be right next to the chicken wing challenge in "Contest/Tournament", however it's looking like a new platform category may be in order -- especially with the launch of our tournament system coming in the near future.



    Edit: Will have to ask Jace on final say, but the original comment was just from my judgement. (I am unsure if this may be a legal liability)

    thx franny. i didnt even consdier that. i'll do what you ask and not argue to much, so take this as a disagreement/question/concern, not a stubborn argument. I agree with you novelty really means "electromechanical" at TG. But i also take tournament to mean, well, a one time tournament, or perhaps a combination of games, like how fast can you finsih 6 mega man games in a row.

    i put my pomeranian tapper, right in atari. cohen put his pomeranian vanguard right in atari 2600. my personal preferecne would be to put a drink while you play one specific arcade title, well, in arcade. or of course a brand new category for the silly stuff

    again, i'll do what you ask, just voicing my opinion on the matter

    I find the idea fun; but from legal point of view thats a big NO. Imagine a scenario where a kid below the legal age would drink alcohol and end up in hospital for alcohol poisoning. And when the authorities asked why did he do it, he would tell there is this gaming site Twin Galaxies and they keep track of some records that include drinking during the performance; and he thought it would be fun to try.

    Even though TG really isn't to blame, it still would get blamed. Even if there wouldn't be any legal repercussion there could be some major backlash on media.

    if underage is your concern we could require it be an actual arcade not at home, that puts the business responsible to check ID. if somehow a kid gets served at a business thats much on them than us. i dont mind adding a rule at has to be at a place of business

    If i have to include that i will. I have concerns with ID because some people wont feel comfortable showing it, and for good reason. then those who do feel comfortable showing might learn why others dont fel comfortable.

    i assume its ok for them to cover all info except photo and dob?

    I suppose the only option for accurate track placement would be to create a new "platform" type.

    After it's creation we can also migrate the Pomeranian tracks, the silly Donkey Kong tracks and other "for fun" tracks there as well.

    Any ideas as to what you would want to call it? (The "platform") Or should the current "Novelty" undergo the name change. Maybe to something like "Electro-Mechanical "

    honestly, that would make more sense to me. rename novelty "electro-mechanical" and then create a new novelty section

    That would cause some confusion at first could since people might confuse the new novelty with the old novelyt,but i think in the long run it will make way more sense and avoid confusion

    In order to better categorize those machines, think it would make the most sense as well. I looked at the novelty platform last night, and I was curious as to what those would actually be called if not "Novelty". Once you said "Electro-Mechanical" everything clicked.

    I suggested the labeling many many many many months ago on that petition...

    All video games are just fir fun. A frustration of mine is delusional people that think video games will make them rich or that their Games are important to fight over but other Games are just for kids

    Unconventional is good. Novelty is good. Remeber donkey Kong no hammer is pretty artificial to yet that one is regarded as serious. The only difference between serious and fun is the amount of people that submit


    I won’t argue the semantics but I do think “artificial rules” or unconventional or novelty are all better than “just fir fun” or anything that implies other games are somehow more than just a way to goof off

    Excellent points already brought up,

    As I see it, No legal issue for TG.

    The game/contest/tournament here would be intended for people who are of legal age to drink alcohol, so no law being broken nor any encouragement to break any laws on the part of TG.

    In the case of underage drinking, that responsibility/liability would fall on the person consuming the alcohol who is underage, as well as the person(s) who furnished them with it, whether it be through store sales or gifted.

    On the matter of suggesting they drink at a place of business, I would not recommend that, because that would involve them drinking in public, which could go beyond acceptable legal levels of intoxication and thus be breaking laws. Also, there is the matter of transportation to and from the establishment, which could also present legal issues for the players. Again, not a direct issue for TG because they did not tell them to drive or drink above legal levels, but a requirement to travel may impose some ramification depending on the judge, I would rather see the rule state that they do it at home, so that their consumption of alcohol does not affect the community directly, and thus avoids those possible complications pertaining to drinking in public.
